§ 49a Ordnungswidrigkeiten

(1) Ordnungswidrig handelt, wer

1. entgegen § 11 ohne wichtigen Grund ein Ehrenamt ablehnt oder sich ohne genügende Entschuldigung den Pflichten eines solchen entzieht oder
2. entgegen § 32 Abs. 2 Ergebnisse von Wählerbefragungen nach der Stimmabgabe über den Inhalt der Wahlentscheidung vor Ablauf der Wahlzeit veröffentlicht.

(2) Die Ordnungswidrigkeit nach Absatz 1 Nr. 1 kann mit einer Geldbuße bis zu tausend Deutsche Mark, die Ordnungswidrigkeit nach Absatz 1 Nr. 2 mit einer Geldbuße bis zu hunderttausend Deutsche Mark geahndet werden.

(3) Verwaltungsbehörde im Sinne des § 36 Abs. 1 Nr. 1 des Gesetzes über Ordnungswidrigkeiten ist

1. bei Ordnungswidrigkeiten nach Absatz 1 Nr. 1
   1. der Kreiswahlleiter, wenn ein Wahlberechtigter das Amt eines Wahlvorstehers, stellvertretenden Wahlvorstehers oder eines Beisitzers im Wahlvorstand oder im Kreiswahlausschuß,
   2. der Landeswahlleiter, wenn ein Wahlberechtigter das Amt eines Beisitzers im Landeswahlausschuß,
   3. der Bundeswahlleiter, wenn ein Wahlberechtigter das Amt eines Beisitzers im Bundeswahlausschuß
   unberechtigt ablehnt oder sich ohne genügende Entschuldigung den Pflichten eines solchen Amtes entzieht,
2. bei Ordnungswidrigkeiten nach Absatz 1 Nr. 2 der Bundeswahlleiter.

Article 49a Infringements repressed by administrative fines

(1) Acts contrary to the payment, which,

1. in violation of Article 11 above, refuses, without serious reason, to exert an honorary function or which, without sufficient excuse, is withdrawn from the inherent obligations in such a function, or which,
2. in violation of subparagraph 2 of Article 32 above, publishes results of electoral surveys after the vote, concerning the contents of the intention of vote, before the closing of the polling stations.

(2) The infringement made under the terms of number 1 of subparagraph 1 above can be repressed by a fine being able to reach up to thousand deutschmarks, the infringement made under the terms of number 2 of subparagraph 1 above, by a fine being able to reach up to a hundred and thousand deutschmarks.

(3) The administrative authority within the meaning of number 1 of subparagraph 1 of Article 36 of the law on the infringements repressed by administrative fines is

1. when they are above infringements made under the terms of number 1 of subparagraph 1,
   1. the president of the electoral commission of district, when a registered voter refuses without valid reason the function of president of polling station, of substitute for the president of or assessor within the electoral office or electoral commission polling station of district, or is withdrawn without sufficient excuse from the inherent obligations in such a function,
   2. the president of the electoral commission of Land, when a registered voter refuses without valid reason the function of assessor within the electoral commission of Land or withdraws himself without sufficient excuse from the inherent obligations in such a function,
   3. the president of the federal electoral Commission, when a registered voter refuses without valid reason the function of assessor within the federal electoral Commission or withdraws himself without sufficient excuse from the inherent obligations in such a function,
2. when they are above infringements made under the terms of number 2 of subparagraph 1, the president of the federal electoral Commission.

§ 49a Irregularities

(1) Concerns order-adversely, who

1. against § 11 without important reason an honorary office rejects or without sufficient apology from the obligations of such extracts themselves or
2. against § 32 exp. of 2 results of voter questionings after the casting of votes over contents of the election decision before flow of the election time publishes.

(2) The irregularity in accordance with paragraph 1 NR. 1 knows the irregularity with a fine up to thousand German Marks, in accordance with paragraph 1 NR. 2 Marks German with a fine up to hundredthousand to be punished.

(3) Administrative authority in the sense § 36 exp. 1 NR. 1 of the law over irregularities is

1. with irregularities in accordance with paragraph 1 NR. 1
   1. of the set returning officers, if a voter the office of a election chief, deputy election chief or an assessor in the wahlvorstand or in the set election commitee,
   2. the national returning officers, if a voter the office of an assessor in the national election commitee,
   3. the federal returning officer, if a voter the office of an assessor in the federal election commitee
   unauthorized rejects or without sufficient apology from the obligations of such an office extracts themselves,
2. with irregularities in accordance with paragraph 1 NR. 2 the federal returning officer.
