§ 36 Briefwahl

(1) Bei der Briefwahl hat der Wähler dem Kreiswahlleiter des Wahlkreises, in dem der Wahlschein ausgestellt worden ist, im verschlossenen Wahlbriefumschlag

1. seinen Wahlschein,
2. in einem besonderen verschlossenen Umschlag seinen Stimmzettel

(2) Auf dem Wahlschein hat der Wähler oder die Hilfsperson gegenüber dem Kreiswahlleiter an Eides Statt zu versichern, daß der Stimmzettel persönlich oder gemäß dem erklärten Willen des Wählers gekennzeichnet worden ist. Der Kreiswahlleiter ist zur Abnahme einer solchen Versicherung an Eides Statt zuständig; er gilt als Behörde im Sinne des § 156 des Strafgesetzbuches.

(3) Im Falle einer Anordnung der Landesregierung oder der von ihr bestimmten Stelle nach § 8 Abs. 3 tritt an die Stelle des Kreiswahlleiters in Absatz 1 Satz 1 und in Absatz 2 die Gemeindebehörde, die den Wahlschein ausgestellt hat, oder die Verwaltungsbehörde des Kreises, in dem diese Gemeinde liegt.

(4) Wahlbriefe können von den Absendern bei der Deutschen Bundespost als Standardbriefe ohne besondere Versendungsform unentgeltlich eingeliefert werden, wenn sie sich in amtlichen Wahlbriefumschlägen befinden. Bei Inanspruchnahme einer besonderen Versendungsform hat der Absender den das jeweils für die Briefbeförderung gültige Leistungsentgelt übersteigenden Betrag zu tragen. Der Bund entrichtet an das Unternehmen Deutsche Bundespost POSTDIENST für jeden von ihm beförderten, unfrei eingelieferten oder durch eine besondere Versendungsform übermittelten amtlichen Wahlbriefumschlag das jeweils für die Briefbeförderung gültige Leistungsentgelt.

Article 36 Vote by correspondence

(1) At the time of the vote by correspondence, the voter must send, under closed envelope,

1. its voter registration card,
2. in a closed envelope, separated, its ballot paper,

(2) On the voter registration card, the voter or the auxiliary must ensure on the honor to the president of the electoral commission of district which it filled the ballot paper personally or in accordance with the declared will of the voter. The president of the electoral commission of district is authorized to receive such an insurance given on the honor; he is regarded as authority within the meaning of Article 156 of the Penal code.

(3) In the emanating case of an ordinance of the government of Land or of a service indicated by its care in accordance with subparagraph 3 of Article 8 above the communal authority which delivered the voter registration card or administrative authority of district whose formed part this commune replaces the president of the electoral commission of district mentioned with the first sentence of subparagraph 1 and subparagraph 2 of this article.

(4) The letters containing the ballot paper can be sent of franking privilege by the shippers by the postal way (federal Post office), as standard letters, in the form of particular forwarding, when they are official envelopes. If the shipper uses a particular form of sending, it must then support itself the carriage costs applicable to the form of selected forwarding. The Federation pays with the company Deutsche Bundespost POSTDIENST the respectively applicable carriage costs for each official envelope containing a ballot paper, not freed and conveyed by its care, or having been the subject of a form of forwarding.

§ 36 Briefwahl

(1) With the briefwahl the voter the set returning officer of the constituency, in which the wahlschein was issued, in the locked election envelope has

1. its wahlschein,
2. in a special locked envelope its voting card

(2) On the wahlschein the voter or the auxiliary person has to insure opposite the set returning officer on oath place that the voting card was indicated personally or in accordance with the avowed will of the voter. The set returning officer is responsible for the reduction of such an insurance on oath place; it is considered as authority in the sense of the § 156 of the penal code.

(3) In the case the municipality authority to the place of the set returning officer in paragraph 1 record 1 and in paragraph 2, which issued the wahlschein, steps an arrangement of the federal state government or the place after § 8 exp. 3, determined by it, or which administrative authority of the set, in which this municipality is situated.

(4) Election letters can be in-supplied of the senders at the Federal Post Office as standard letters without special dispatching form free of charge, if they are in official election envelopes. With recourse to of a special dispatching form the sender has to carry valid in each case the performance payment for the briefbefoerderung for exceeding amount. The federation paid to the enterprise the Federal Post Office POSTAL SERVICE for each by it carried, unfreely in-supplied or by a special dispatching form transmitted official election envelope valid in each case the performance payment for the briefbefoerderung.
