§ 48 Berufung von Listennachfolgern und Ersatzwahlen

(1) Wenn ein gewählter Bewerber stirbt oder die Annahme der Wahl ablehnt oder wenn ein Abgeordneter stirbt oder sonst nachträglich aus dem Deutschen Bundestag ausscheidet, so wird der Sitz aus der Landesliste derjenigen Partei besetzt, für die der Ausgeschiedene bei der Wahl aufgetreten ist. Bei der Nachfolge bleiben diejenigen Listenbewerber unberücksichtigt, die seit dem Zeitpunkt der Aufstellung der Landesliste aus dieser Partei ausgeschieden sind. Ist die Liste erschöpft, so bleibt der Sitz unbesetzt. Die Feststellung, wer als Listennachfolger eintritt, trifft der Landeswahlleiter. § 42 Abs. 3 und § 45 gelten entsprechend.

(2) Ist der Ausgeschiedene als Wahlkreisabgeordneter einer Wählergruppe oder einer Partei gewählt, für die im Land keine Landesliste zugelassen worden war, so findet Ersatzwahl im Wahlkreis statt. Die Ersatzwahl muß spätestens sechzig Tage nach dem Zeitpunkt des Ausscheidens stattfinden. Sie unterbleibt, wenn feststeht, daß innerhalb von sechs Monaten ein neuer Deutscher Bundestag gewählt wird. Die Ersatzwahl wird nach den allgemeinen Vorschriften durchgeführt. Den Wahltag bestimmt der Landeswahlleiter. § 41 Abs. 2 und § 45 gelten entsprechend.

Article 48 Designation of successors on the list and complementary elections

(1) If an elected candidate has suddenly died or if it refuses to accept the election, or if a deputy has suddenly died or ceases, thereafter, to belong to the Bundestag, then the emanating seat of the list of Land is occupied by the party for which the deputy who leaves the Bundestag was candidate at the time of the election. At the time of the succession, it is not taken account of the candidates having been reproduced on the list who left this party since the moment when the list of Land was drawn up. If the list is exhausted, the seat remains unoccupied. The decision as for knowing which takes into consideration as a successor on the list is made by the president of the electoral commission of Land. Subparagraph 3 of Article 42 and Article 45 above are applicable mutatis mutandis.

(2) If the deputy who from goes away were elected as a deputy of electoral district of a group of voters or a party for which no list of Land had been allowed in Land, then it is proceeded to a complementary election in the electoral district. The complementary election must be organized at the latest in the sixty days which follow the day when it left the Bundestag. It is not organized when it is established that the new Bundestag will be elected in the six months which follows. The complementary election will proceed according to general regulations'. The president of the electoral commission of Land will fix the day of the election. Subparagraph 2 of Article 41 and Article 45 above are applicable mutatis mutandis.

§ 48 Appointment of list successors and sustitude choices

(1) If a elected applicant dies or rejects the acceptance of the election or if a delegate dies or separates otherwise subsequently from the German Bundestag, then the seat from the national list of that party is filled, for which the separating occurred with the election. With the follow-up those list applicants remain unconsidered, who separated since the point in time of the list of the national list from this party. If the list is exhausted, then the seat remains vacant. The statement, who occurs as a list successor, meets the national returning officer. § 42 exp. 3 and § 45 apply accordingly.

(2) If the separating is elected as a constituency delegate of a group of voters or a party, for which in the country no national list certified was, then sustitude choice in the constituency takes place. The sustitude choice must take place at the latest sixty days after the point in time of separating. It is omitted, if it is certain that within six months new German Bundestag is elected. The sustitude choice is executed according to the general regulations. The national returning officer determines the election day. § 41 exp. 2 and § 45 apply accordingly.
