§ 47 Entscheidung über den Verlust der Mitgliedschaft

(1) Über den Verlust der Mitgliedschaft nach § 46 Abs. 1 wird entschieden

  1. im Falle der Nummer 1 im Wahlprüfungsverfahren,
  2. im Falle der Nummern 2 und 5 durch Beschluß des Ältestenrates des Deutschen Bundestages,
  3. im Falle der Nummer 3, wenn der Verlust der Wählbarkeit durch rechtskräftigen Richterspruch eingetreten ist, durch Beschluß des Ältestenrates des Deutschen Bundestages, im übrigen im Wahlprüfungsverfahren,
  4. im Falle der Nummer 4 durch den Präsidenten des Deutschen Bundestages in der Form der Erteilung einer Bestätigung der Verzichtserklärung.

(2) Wird über den Verlust der Mitgliedschaft im Wahlprüfungsverfahren entschieden, so scheidet der Abgeordnete mit der Rechtskraft der Entscheidung aus dem Deutschen Bundestag aus.

(3) Entscheidet der Ältestenrat oder der Präsident des Deutschen Bundestages über den Verlust der Mitgliedschaft, so scheidet der Abgeordnete mit der Entscheidung aus dem Deutschen Bundestag aus. Die Entscheidung ist unverzüglich von Amts wegen zu treffen. Innerhalb von zwei Wochen nach Zustellung der Entscheidung kann der Betroffene die Entscheidung des Deutschen Bundestages über den Verlust der Mitgliedschaft im Wahlprüfungsverfahren beantragen. Die Zustellung erfolgt nach den Vorschriften des Verwaltungszustellungsgesetzes.

第47条 議員の地位の喪失に関する決定

(1) 第46条第１項による議員の地位の喪失に関しては、次に掲げる方法によって決定される。

  1. 第１号の場合にあっては、選挙審査手続
  2. 第２号及び第５号の場合にあっては、ドイツ連邦議会の長老会議の決議
  3. 第３号の場合にあっては、裁判所の有効な決定による被選挙権の喪失ならばドイツ連邦議会の長老会議の決議、その他の場合は選挙審査手続
  4. 第４号の場合にあっては、辞表の受理書の交付という形でドイツ連邦議会の議長

(2) 選挙審査手続において議員の地位の喪失につき決定された場合、議員は決定の法的既判力によりドイツ連邦議会から離脱する。

(3) 長老会議またはドイツ連邦議会の議長が、議員の地位の喪失につき決定した場合、その決定により議員はドイツ連邦議会から離脱する。決定は職権により遅滞なくなされなければならない。決定の送達後２週間以内において利害関係者は、議員の地位の喪失に関するドイツ連邦議会の決定に異議を申し立てることができる。送達は、行政送達法の規定に従って行われる。

Article 47 Decision about the loss of the membership

(1) He is decided loss of the membership in accordance with subparagraph 1 of Article 46 above

  1. in the case quoted with number 1, according to a procedure of checking of the poll,
  2. in the case quoted with numbers 2 and 5, by a decision taken by the conference of the representatives of the parliamentary groups of the Bundestag,
  3. in the case quoted with number 3, when the loss of eligibility intervened under the terms of a judgement having force of judged thing, under the terms of a decision taken by the conference of the representatives of the parliamentary groups of the Bundestag, for the remainder according to a procedure of checking of the poll,
  4. in the case quoted with number 4, by the president of the Bundestag, in the form of the handing-over of a confirmation of notice of surrender.

(2) If it is decided loss of the membership according to the procedure of checking of the poll, then the deputy ceases belonging to the Bundestag at the time when the decision has force of judged thing.

(3) If the conference of the representatives of the parliamentary groups or the president of the Bundestag decides loss of the membership, then the deputy ceases belonging to the Bundestag at the time when is made the decision. The decision must be made of office and immediately. The interested party can ask that the Bundestag rule on the loss of the membership according to the procedure of checking of the poll in the two weeks which follow the notification of the decision. The notification is made in accordance with the regulations of the law governing the administrative notification.

§ 47 Decision over the loss of the membership

(1) On the loss of the membership after § 46 exp. 1 one decides

  1. in the case of the number 1 in the election check procedure,
  2. in the case of the numbers 2 and 5 by resolution of the Council of Elders of the German federal diet,
  3. in the case of the number 3, if the loss of the eligibility occurred by valid court decision, by resolution of the Council of Elders of the German federal diet, in all other respects in the election check procedure,
  4. in the case of the number 4 by the president of the German federal diet in the form of the distribution of an acknowledgement of the waiver.

(2) One decides on the loss of the membership in the election check procedure, then the delegate with the validity in law of the decision from the German Bundestag separates.

(3) If the Council of Elders or the president of the German federal diet decides on the loss of the membership, then the delegate with the decision from the German Bundestag separates. The decision is to be made immediately officially. Within two weeks after feed of the decision the concerning can request the decision of the German federal diet over the loss of the membership in the election check procedure. The feed takes place according to the regulations of the administrative feed law.
