§ 45 Erwerb der Mitgliedschaft im Deutschen Bundestag
Ein gewählter Bewerber erwirbt die Mitgliedschaft im Deutschen Bundestag mit dem frist- und formgerechten Eingang der auf die Benachrichtigung nach § 41 Abs. 2 oder § 42 Abs. 3 erfolgenden Annahmeerklärung beim zuständigen Wahlleiter, jedoch nicht vor Ablauf der Wahlperiode des letzten Deutschen Bundestages und im Falle des § 44 Abs. 4 nicht vor Ausscheiden des nach dem ursprünglichen Wahlergebnis gewählten Abgeordneten. Gibt der Gewählte bis zum Ablauf der gesetzlichen Frist keine oder keine formgerechte Erklärung ab, so gilt die Wahl zu diesem Zeitpunkt als angenommen. Eine Erklärung unter Vorbehalt gilt als Ablehnung. Annahme- und Ablehnungserklärung können nicht widerrufen werden.

第45条 ドイツ連邦議会における議員の地位の取得
当選した候補者は、所轄選挙長に、第41条第２項または第42条第３項による通知に従った承諾の意思表示が、規定された期間および形式で到達することにより、ドイツ連邦議会における議員の地位を取得する。ただし、前回のドイツ連邦議会の選挙期の経過する前および第44条第４項の場合においてはもとの選挙の結果によって当選した議員が離脱する前には、その地位を取得しない。当選人が法定の期間の満了するまでにどのような意思表示も与えないか、または規定された形式の意思表示を与えなかったときは、選挙は、この時点において承諾されたものとみなされる。留保を伴う意思表示は、拒否とみなされる。承諾および拒否は、取り消すことができない。

Article 45 Acquisition of the membership of the Bundestag
The elected candidate acquires the membership of the Bundestag at the time of the reception in conformity with the time and the form of the declaration of acceptance made to the qualified president of the polling station, following the notification envisaged with subparagraph 2 of Article 41 or subparagraph 3 of Article 42 above. He does not acquire however this quality before the expiry of the legislature of the last Bundestag and, in the case envisaged with subparagraph 4 of Article 44 above, not before the departure of the deputy elected in accordance with the initial electoral result. If the elected official does not make any statement or in due form does not make a statement until the expiry of the legal period, then the election is regarded as being accepted at this time there. A declaration provided is regarded as a refusal. The declarations of acceptance and refusal cannot be revoked.
§ 45 Acquisition of the membership in the German Bundestag
An elected applicant does not acquire the membership in the German Bundestag with period and formal input on the notification after § 41 of the exp. 2 or § 42 exp. 3 taking place notification of acceptance with the responsible returning officer, however before flow of the electoral period of the last German federal Diet and in the case of the § 44 exp. 4 not before separating the delegate elected after the original election result. If the electing up to the flow of the legal period makes no or no formal declaration, then the election applies at this time as assumed. An assertion under reservation is considered as refusal. Acceptance and formal rejection cannot be recalled.
