Artikel 56.(1) Die Mitglieder des Nationalrates und die Mitglieder des Bundesrates sind bei der Ausübung dieses Berufes an keinen Auftrag gebunden.(2) Hat ein Mitglied der Bundesregierung oder ein Staatssekretär auf sein Mandat als Mitglied des Nationalrates verzichtet, so ist ihm nach dem Ausscheiden aus diesem Amt, in den Fällen des Artikel 71 nach der Enthebung von der Betrauung mit der Fortführung der Verwaltung, von der zuständigen Wahlbehörde das Mandat erneut zuzuweisen, wenn der Betreffende nicht gegenüber der Wahlbehörde binnen acht Tagen auf die Wiederausübung des Mandates verzichtet hat. (3) Durch diese erneute Zuweisung endet das Mandat jenes Mitgliedes des Nationalrates, welches das Mandat des vorübergehend ausgeschiedenen Mitgliedes innegehabt hat, sofern nicht ein anderes Mitglied des Nationalrates, das später in den Nationalrat eingetreten ist, bei seiner Berufung auf sein Mandat desselben Wahlkreises gegenüber der Wahlbehörde die Erklärung abgegeben hat, das Mandat vertretungsweise für das vorübergehend ausgeschiedene Mitglied des Nationalrates ausüben zu wollen. (4) Abs. 2 und 3 gelten auch, wenn ein Mitglied der Bundesregierung oder ein Staatssekretär die Wahl zum Mitglied des Nationalrates nicht angenommen hat.

第56条(1) 国民議会議員および連邦参議院議員は、付託をうけた職務の行使に際して如何なる拘束も受けない。(2) 連邦政府の閣僚または次官が、国民議会議員としてその職を辞した場合は、当該者が選挙官庁に対して８日内に職の再行使を辞さなかった時、この職からの退任後、行政の継続のための委嘱の解任後の第71条の場合において、管轄する選挙官庁は、当該者にその職を更に改めて指定することとする。 (3) この更新された指定により、後に国民議会議員となった他の国民議会議員が, 同一選挙区のその職への任命に際して選挙官庁に対して、職を暫定的に退任した国民議会議員に代わって行使したい旨、表明しない限り、暫定的に退任した閣僚の職を占めていた、その国民議会議員の職は終了する。 (4) 連邦政府の閣僚または次官が、国民議会議員への選挙を棄権したばあいも、第２項および第３項を準用する。

Art. 56.(1) The members of the National Council and the members of the Federal Council are bound in the exercise of their function by no mandate.(2) If a member of the Federal Government or a State Secretary has relinquished his seat as a member of the National Council, the competent electoral board shall again assign him the seat when he has left office, in the circumstances of Art. 71 after release from entrustment with continuation of the administration, provided that he has not within eight days advised the board of his disclaimer to the renewed exercise of his mandate. (3) This renewed assignment ends the mandate of that National Council member who has held the seat of the temporarily retired member in so far as another, subsequent National Council member did not on the occasion of nomination to the seat in the same constituency declare to the electoral board his wish to exercise the mandate as deputy for the temporarily retired member of the National Council. (4) Paras. 2 and 3 also hold good if a member of the Federal Government or a State Secretary has not accepted his election to membership of the National Council.
