Artikel 109.In den Angelegenheiten der mittelbaren Bundesverwaltung geht der Instanzenzug, soweit ein solcher nicht durch Bundesgesetz ausgeschlossen ist, im Lande Wien vom Magistrat als Bezirksverwaltungsbehörde oder, soweit in erster Instanz Bundesbehörden mit der Vollziehung betraut sind (Artikel 102 Absatz 1 zweiter Satz), von diesen an den Bürgermeister als Landeshauptmann; im übrigen gilt Artikel 103 Absatz 4.ANMERKUNG ÜR: Artikel VI BVG, BGBl. Nr. 444/1974.

第109条間接的連邦行政に関する事項においては、行政的審級は、連邦法により除外されていない限り、州ヴィーンでは地区行政官庁としての市政庁によって、または、第一審において連邦官庁が執行を委嘱される限り（第102条第１項第２段）、州知事としての市長に帰属し、その他においては第103条第４項を準用する。

Art. 109.In Land Vienna the chain of appeal in matters pertaining to the indirect Federal administration, unless precluded by Federal law, is from the City administration acting as district administrative authority or, in so far as Federal authorities are in the first instance entrusted with their execution (Art. 102, para. 1 second sentence), from them to the mayor in his capacity as Governor; in other respects Art. 103 para. 4 applies.
