§ 8 Gliederung der Wahlorgane

(1) Wahlorgane sind

  • der Bundeswahlleiter und der Bundeswahlausschuß für das Wahlgebiet,
  • ein Landeswahlleiter und ein Landeswahlausschuß für jedes Land,
  • ein Kreiswahlleiter und ein Kreiswahlausschuß für jeden Wahlkreis,
  • ein Wahlvorsteher und ein Wahlvorstand für jeden Wahlbezirk und
  • mindestens ein Wahlvorsteher und ein Wahlvorstand für jeden Wahlkreis zur Feststellung des Briefwahlergebnisses.
Wieviel Briefwahlvorstände zu bilden sind, um das Ergebnis der Briefwahl noch am Wahltage feststellen zu können, bestimmt der Kreiswahlleiter.

(2) Für mehrere benachbarte Wahlkreise kann ein gemeinsamer Kreiswahlleiter bestellt und ein gemeinsamer Kreiswahlausschuß gebildet werden; die Anordnung trifft der Landeswahlleiter.

(3) Zur Feststellung des Briefwahlergebnisses können Wahlvorsteher und Wahlvorstände statt für jeden Wahlkreis für einzelne oder mehrere Gemeinden oder für jeden Kreis innerhalb des Wahlkreises eingesetzt werden; die Anordnung trifft die Landesregierung oder die von ihr bestimmte Stelle.

第８条 選挙機関の区分

(1) 選挙機関は、次に掲げるものである。

  • 選挙地域について一人の連邦選挙長及び一つの連邦選挙委員会、
  • 各州について一人の州の選挙長及び一つの州選挙委員会、
  • 各選挙区について一人の選挙区選挙長及び一つの選挙区選挙委員会、
  • 各投票区について一人の投票管理者及び一つの投票所、そして
  • 各選挙区について郵便投票の結果の確認のために、最低一人の投票管理者及び一つの投票所。
投票日に郵便投票の結果を確定できるようにするために、いくつの郵便投票所を設置するかは選挙区選挙長が決定する。

(2) 隣接する多数の選挙区について共同の一人の選挙区選挙長を任命し及び共同の一つの選挙区選挙委員会を組織することができ、選挙長がこれを決定する。

(3) 郵便投票の結果の確認のために、各選挙区に代わり、単独のまたは数個の市町村について、あるいは選挙区の中の各地区について、投票管理者と投票所を設置することができ、州政府または州政府の定める官庁がこれを決定する。

Article 8 Division of the electoral bodies

(1) The electoral bodies are

  • the president of the federal electoral commission and the federal electoral commission on the area where take place the elections,
  • a president of the electoral commission of Land and an electoral commission of Land for each Land,
  • a person in charge of an electoral sector of district and an electoral office of district for each electoral district,
  • a president of the electoral commission and a polling station for each electoral district and
  • at least a person in charge of an electoral sector and a polling station for each electoral district, in order to carry out the examination of the vote by correspondence.
The person in charge of the polling station of district fixes the number of electoral offices for the votes by correspondence to be created, in order to be able to strip, still the day of the election, the votes by correspondence.

(2) For several close electoral districts, it can be carried out the designation of a president of the electoral commission of district common and made up an electoral commission of district commune; the ordinance is taken by the president of the electoral commission of Land.

(3) In order to carry out the examination of the votes by correspondence, it can be proceeded to the installation of presidents of electoral office and polling stations for different or several communes or for each district inside the electoral district, instead of envisaging them for each electoral district; the ordinance will be taken by the government of Land or the service indicated by its care.

§ 8 Arrangement of the election organs

(1) Election organs are

  • the federal returning officer and the federal election commitee for the election area,
  • a national returning officer and a national election commitee for each country,
  • a set returning officer and a set election commitee for each constituency,
  • an election chief and a wahlvorstand for each electoral district and
  • at least one election chief and a wahlvorstand for each constituency for the statement of the resultresult result.
How much executive committeeexecutive committee executive committees are to be formed, in order to be able to determine the result of the briefwahl still on the election day, the set returning officer determines.

(2) For several neighbouring constituencies a common set returning officer can be ordered and a common set election commitee be formed; the arrangement meets the national returning officer.

(3) For the statement of the resultresult result election chiefs and wahlvorstaende can be used instead of for each constituency for particulars or several municipalities or for each set within the constituency; the arrangement meets the federal state government or the place determined by it.
