§ 15 Wählbarkeit

(1) Wählbar ist, wer am Wahltage

  1. seit mindestens einem Jahr Deutscher im Sinne des Artikels 116 Abs. 1 des Grundgesetzes ist und
  2. das achtzehnte Lebensjahr vollendet hat.

(2) Nicht wählbar ist,

  1. wer nach § 13 vom Wahlrecht ausgeschlossen ist,
  2. wer infolge Richterspruchs die Wählbarkeit oder die Fähigkeit zur Bekleidung öffentlicher Ämter nicht besitzt oder
  3. wer, ohne die deutsche Staatsangehörigkeit zu besitzen, Deutscher im Sinne des Artikels 116 Abs. 1 des Grundgesetzes ist und diese Rechtsstellung durch Ausschlagung der deutschen Staatsangehörigkeit nach dem Gesetz zur Regelung von Fragen der Staatsangehörigkeit vom 22. Februar 1955 (BGBl. I S. 65) erlangt hat.

第15条 被選挙権

(1) 選挙の当日において次の各号全てに該当する者は、被選挙権を有する。

  1. 少なくとも１年以来、基本法第116条第１項の意義におけるドイツ人である者
  2. 満年齢18年以上の者

(2) 次に掲げる者は、被選挙権を有しない。

  1. 第13条の規定により選挙権から除斥された者
  2. 確定判決により、被選挙権または公職に就く資格を有しない者
  3. ドイツ国籍を有することなくして基本法第116条第１項の意義におけるドイツ人であり、而してこの法律上の地位を1955年2月22日の国籍問題処理法（連邦官報Ｉ65頁）によってドイツの国籍を拒否することによって取得した者

Article 15 Eligibility

(1) Is eligible which, the day of the election,

  1. has been for at least a year German citizen within the meaning of subparagraph 1 of Article 116 of the fundamental Law and
  2. reached the 18 years age accomplished.

(2) Is not eligible,

  1. which is excluded from the voting rights under the terms of Article 13 above,
  2. which, following a given judgement, does not have eligibility or the capacity to assume public office, or
  3. who, without having German nationality, is German citizen within the meaning of subparagraph 1 of Article 116 of the fundamental Law and acquired this legal statute while renon軋nt with German nationality, in accordance with the law settling the questions of nationality, on February 22, 1955 (Official Journal federal I, p. 65).

§ 15 Eligibility

(1) Electable is, who on the election day

  1. for at least one year German in the sense of the article 116 exp. 1 of the Basic Law is and
  2. the eight tenth lebensjahr completed.

(2) Is not electable,

  1. who is impossible from the right to vote after § 13,
  2. who does not possess due to court decision the eligibility or the ability to the clothing of public offices or
  3. who, without being a German national, German in the sense of the article 116 exp. 1 of the Basic Law is and this legal status attained by deflecting the German nationality after the law for the regulation of questions of the nationality from 22 February 1955 (BGBl. I P. 65).
