Artikel 87.(1) Die Richter sind in Ausübung ihres richterlichen Amtes unabhängig.(2) In Ausübung seines richterlichen Amtes befindet sich ein Richter bei Besorgung aller ihm nach dem Gesetz und der Geschäftsverteilung zustehenden gerichtlichen Geschäfte, mit Ausschluß der Justizverwaltungssachen, die nicht nach Vorschrift des Gesetzes durch Senate oder Kommissionen zu erledigen sind. (3) Die Geschäfte sind unter die Richter eines Gerichtes für die in der Gerichtsverfassung bestimmte Zeit im voraus zu verteilen. Eine nach dieser Geschäftsverteilung einem Richter zufallende Sache darf ihm nur durch Verfügung des durch die Gerichtsverfassung hiezu berufenen Senates und nur im Fall seiner Verhinderung oder dann abgenommen werden, wenn er wegen des Umfangs seiner Aufgaben an deren Erledigung innerhalb einer angemessenen Frist gehindert ist.

第87条(1) 裁判官は、その裁判官職の行使において独立である。(2) 裁判官職の行使においては、裁判官は、法律および業務分担により裁判官に帰属する裁判上の全ての業務を行うに際して、法律の規定に従って裁判所の部または委員会によって解決されない、司法行政事件は担当しない。 (3) 業務は、裁判所構成において定められた時間に関して、裁判所の裁判官に、前もって割り当てられることとする。この業務分担に従って裁判官に帰した事件からは、裁判官は、裁判所構成法によりここに使命をうけた裁判所の部の命令によってのみ、および、裁判官に故障ある場合にのみ、または裁判官がその任務範囲の故に相応の期間内の結審を妨げられた時に、解放されることができる。

Art. 87.(1) Judges are independent in the exercise of their judicial office.(2) A judge is in the exercise of his judicial office during the performance of any judicial function properly his by law and the allocation of business, though to the exclusion of the judiciary's administrative business which in accordance with the provisions of the law shall not be discharged by chambers or commissions. (3) Business shall be allocated in advance among the judges of a court for the period provided by the law on the organization of the courts. A matter devolving upon a judge in accordance with this allocation may be removed from his jurisdiction by decree of the judiciary's administrative authorities only in case of his being prevented from the discharge of his responsibilities or his being unable to cope with his duties, due to their extent, within a reasonable time.
