Artikel 79.

(1) Dem Bundesheer obliegt die militärische Landesverteidigung. Es ist nach den Grundsätzen eines Milizsystems einzurichten.

(2) Das Bundesheer ist, soweit die gesetzmäßige bürgerliche Gewalt seine Mitwirkung in Anspruch nimmt, ferner bestimmt

  1. auch über den Bereich der militärischen Landesverteidigung hinaus
    1. ) zum Schutz der verfassungsmäßigen Einrichtungen und ihrer Handlungsfähigkeit sowie der demokratischen Freiheiten der Einwohner

    2. ) zur Aufrechterhaltung der Ordnung und Sicherheit im Inneren überhaupt;

  2. zur Hilfeleistung bei Elementarereignissen und Unglücksfällen außergewöhnlichen Umfanges.

(3) Weitere Aufgaben des Bundesheeres werden durch Bundesverfassungsgesetz geregelt.

(4) Welche Behörden und Organe die Mitwirkung des Bundesheeres zu den im Absatz 2 genannten Zwecken unmittelbar in Anspruch nehmen können, bestimmt das Wehrgesetz.

(5) Selbständiges militärisches Einschreiten zu den im Absatz 2 genannten Zwecken ist nur zulässig, wenn entweder die zuständigen Behörden durch höhere Gewalt außerstande gesetzt sind, das militärische Einschreiten herbeizuführen, und bei weiterem Zuwarten ein nicht wieder gutzumachender Schaden für die Allgemeinheit eintreten würde, oder wenn es sich um die Zurückweisung eines tätlichen Angriffes oder um die Beseitigung eines gewalttätigen Widerstandes handelt, die gegen eine Abteilung des Bundesheeres gerichtet sind.

第79条

(1) 連邦軍は、軍事的国土防衛の義務を負う。連邦軍は、民兵制の原則に従って組織する。

(2) 連邦軍は、適法な市民の権限により連邦軍の参加が要求される場合には、さらに以下の各号の目的につき義務を負う。

  1. 軍事的国土防衛の範囲を越える場合であっても
    1. ) 憲法的機構、およびその行為能力、ならびに住民の民主的自由の保護のために

    2. ) 連邦内の秩序および安全全般の維持のために

  2. 天災および大惨事に際しての救助のために

(3) 連邦軍の任務の委細は、連邦の憲法的法律によって定める。

(4) 如何なる官庁および機関が、第２項に掲げられた目的のために連邦軍の協力を直接要求することができるかは、軍法によって定める。

(5) 第２項に掲げられた目的のための自主的な軍の介入は、管轄官庁が不可抗力により軍の介入を導入することを不可能とする状況におかれ、待ち続けることにより回復できない被害が一般に及ぶ場合、もしくは、連邦軍の一部に対して向けられた暴行の拒絶または無法な抵抗の除去に関する場合にのみ許容される。

Art. 79.

(1) The country's military defence is the duty of the Federal Army. It shall be conducted on the principles of a militia system.

(2) The Federal Army, in so far as the lawful civil power claims its co-operation, has furthermore

  1. also beyond above the sphere of the country's military defence

    1. ) to protect the constitutionally established institutions as well as their capacity to operate and the population's democratic freedoms,

    2. ) to maintain order and security inside the country in general;

  2. to render assistance in the case of natural catastrophes and disasters of exceptional magnitude.

(3) Additional tasks of the Federal Army will be prescribed by Federal constitutional law.

(4) The Defence Law regulates which officials and authorities can lay direct claim to the co-operation of the Federal Army for the purposes mentioned in para. 2 above.

(5) Intervention by the military on its own initiative for the purposes mentioned in para. 2 above is admissible only if circumstances outside their control have put it beyond capacity of the competent officials to effect intervention by the military and irreparable damage the community at large would arise from a further wait or if it concerns the repulse of an actual attack, or the elimination of active resistance directed against a section of the Federal Army.
