Artikel 148g.(1) Die Volksanwaltschaft hat ihren Sitz in Wien. Sie besteht aus drei Mitgliedern, von denen jeweils eines den Vorsitz ausübt. Die Funktionsperiode beträgt sechs Jahre. Eine mehr als einmalige Wiederwahl der Mitglieder der Volksanwaltschaft ist unzulässig.(2) Die Mitglieder der Volksanwaltschaft werden vom Nationalrat auf Grund eines Gesamtvorschlages des Hauptausschusses gewählt. Der Hauptausschuß erstellt seinen Gesamtvorschlag bei Anwesenheit von mindestens der Hälfte seiner Mitglieder, wobei die drei mandatsstärksten Parteien des Nationalrates das Recht haben, je ein Mitglied für diesen Gesamtvorschlag namhaft zu machen. Die Mitglieder der Volksanwaltschaft leisten vor Antritt ihres Amtes dem Bundespräsidenten die Angelobung. (3) Der Vorsitz in der Volksanwaltschaft wechselt jährlich zwischen den Mitgliedern in der Reihenfolge der Mandatsstärke der die Mitglieder namhaft machenden Parteien. Diese Reihenfolge wird während der Funktionsperiode der Volksanwaltschaft unverändert beibehalten. (4) Im Falle des vorzeitigen Ausscheidens eines Mitgliedes der Volksanwaltschaft hat jene im Nationalrat vertretene Partei, die dieses Mitglied namhaft gemacht hat, ein neues Mitglied namhaft zu machen. Die Neuwahl für den Rest der Funktionsperiode ist gemäß Abs. 2 durchzuführen. (5) Die Mitglieder der Volksanwaltschaft müssen zum Nationalrat wählbar sein; sie dürfen während ihrer Amtstätigkeit weder der Bundesregierung noch einer Landesregierung noch einem allgemeinen Vertretungskörper angehören und keinen anderen Beruf ausüben. 第148g条(1) オンブズマンは、その所在地をヴィーンに置く。オンブズマンは、構成員３名より成り、その中よりその都度、１名が議長を勤める。任期は、６年とする。オンブズマンの構成員の１回以上の再選は、認められない。(2) オンブズマンの構成員は、国民議会が主要委員会の全体推薦に基づき選出する。主要委員会は、委員の半数以上の出席により、その全体推薦を調整し、その際、国民議会の議席上の３大政党が、各１名の構成員を当該全体推薦に関して指名する権利を有する。オンブズマンの構成員は、就任に先立ち、連邦大統領に宣誓を行う。 (3) オンブズマンにおける議長は、構成員を指名した政党の議席勢力の順に構成員間で毎年交替する。この順番は、オンブズマンの任期中は変更できない。 (4) オンブズマンの構成員の任期前の退任の場合には、この構成員を指名した、国民議会において議席を有する政党は、新たな構成員を指名しなければならない。任期の残りに関する新たな選挙は、第２項に従って実施されることとする。 (5) オンブズマンの構成員は、国民議会への被選挙権を有さなければならず、その任期中は連邦政府にも、州政府にも、一般的代議機関にも属してはならず、その他一切の職業にも就いてはならない。

Art. 148g.(1) The ombudsman board has its seat in Vienna and consists of three members one of whom acts in turn as chairman. The term of office lasts six years. Re-election of the ombudsman board's members more than once is inadmissible.(2) Ombudsman board members are elected by the National Council on the basis of a joint recommendation drawn up by the Main Committee in the presence of at least half its members. Each of the three parties with the largest number of votes in the National Council is entitled to nominate one member for this recommendation. The members of the ombudsman board render an affirmation to the Federal President before their assumption of office. (3) The ombudsman board chairmanship rotates annually between the members in the sequence of the voting strength possessed by the parties who have nominated them. This sequence remains unchanged during the ombudsman board's term of office. (4) Should a ombudsman board member retire prematurely, the party represented in the National Council who nominated this member shall nominate a new member. The new election for the remaining term of office shall be effected pursuant to para. 2 above. (5) Ombudsman board members must be eligible for the National Council; during their service in office they may belong neither to the Federal Government nor to a Land government nor to any popular representative body and they may not practise any other profession.
