§ 9 Bildung der Wahlorgane

(1) Der Bundeswahlleiter und sein Stellvertreter werden vom Bundesministerium des Innern, die Landeswahlleiter, Kreiswahlleiter und Wahlvorsteher sowie ihre Stellvertreter von der Landesregierung oder der von ihr bestimmten Stelle ernannt.

(2) Der Bundeswahlausschuß besteht aus dem Bundeswahlleiter als Vorsitzendem und acht von ihm berufenen Wahlberechtigten als Beisitzern. Die übrigen Wahlausschüsse bestehen aus dem Wahlleiter als Vorsitzendem und sechs von ihm berufenen Wahlberechtigten als Beisitzern. Die Wahlvorstände bestehen aus dem Wahlvorsteher als Vorsitzendem, seinem Stellvertreter und weiteren drei bis fünf vom Wahlvorsteher berufenen Wahlberechtigten als Beisitzern; die Landesregierung oder die von ihr bestimmte Stelle kann anordnen, daß die Beisitzer des Wahlvorstandes von der Gemeindebehörde und die Beisitzer des Wahlvorstandes zur Feststellung des Briefwahlergebnisses vom Kreiswahlleiter, im Falle einer Anordnung nach § 8 Abs. 3 von der Gemeindebehörde oder von der Kreisverwaltungsbehörde allein oder im Einvernehmen mit dem Wahlvorsteher berufen werden. Bei Berufung der Beisitzer sind die in dem jeweiligen Bezirk vertretenen Parteien nach Mögli chkeit zu berücksichtigen.

(3) Niemand darf in mehr als einem Wahlorgan Mitglied sein. Wahlbewerber, Vertrauenspersonen für Wahlvorschläge und stellvertretende Vertrauenspersonen dürfen nicht zu Mitgliedern eines Wahlorgans bestellt werden.

Article 9 Constitution of the electoral bodies

(1) The president of the federal electoral Commission and his substitute are appointed by the federal Ministry of the Interior, the presidents of the polling stations of Land, the presidents of the polling stations of district and the presidents of the polling stations like their substitutes, by the government of Land or the service indicated by his care.

(2) The federal electoral Commission is composed of the president of the federal electoral Commission, as a president, and of eight registered voters designated by its care, as assessors. The other electoral commissions are made up of the president of the electoral commission as a president and six registered voters designated by its care, as assessors. The electoral offices are composed of the person in charge of an electoral sector as a president, his substitute and three to five other registered voters designated by the person in charge of an electoral sector, as assessors; the government of Land or the service indicated by its care can order that the assessors of the electoral office are appointed by the communal authority and the assessors of the electoral office charged to strip the votes by correspondence, by the president of the electoral office of district. The government of Land or the service indicated by its care can, in the case of an ordinance taken in accordance with subparagraph 3 of Article 8 above, to order that it is indicated by the communal authority or the administrative authority of district acting only or by mutual agreement with the person in charge of an electoral sector. During the assessor nomination, it is necessary to hold account, as much as possible, of the parties represented in the respective electoral district.

(3) Nobody can be member of more than only one electoral body. The candidates, the delegates for the lists of candidates as their substitutes cannot be designated as members of an electoral body.

§ 9 Formation of the election organs

(1) The federal returning officer and its deputy are appointed by the Federal Ministry of the Interior, the national returning officers, set returning officer and election chief as well as their deputies of the federal state government or the place determined by it.

(2) The federal election commitee consists of the federal returning officer as presiding and eight voters appointed of it as assessors. The remaining election commitees consist of the returning officer as presiding and six voters appointed of him as assessors. The wahlvorstaende consist of the election chief as presiding, its deputy andurther three to five voters than assessors, appointed by the election chief; the federal state government or the place determined by it can arrange that the assessors of the wahlvorstandes of the municipality authority and the assessors of the wahlvorstandes will appoint as the statement of the resultresult result of the set returning officer, in the case of an arrangement after § 8 exp. 3 of the municipality authority or of the district administration authority alone or in agreement with the election chief. With appointment of the assessors the parties represented in the respective district are to be considered after possibility.

(3) Nobody may being in more than one election organ member. Election applicants, men of confidence for election suggestions and deputy men of confidence may not be ordered to members of an election organ.
