§ 12 Wahlrecht

(1) Wahlberechtigt sind alle Deutschen im Sinne des Artikels 116 Abs. 1 des Grundgesetzes, die am Wahltage

1. das achtzehnte Lebensjahr vollendet haben,
2. seit mindestens drei Monaten in der Bundesrepublik Deutschland eine Wohnung innehaben oder sich sonst gewöhnlich aufhalten,
3. nicht nach § 13 vom Wahlrecht ausgeschlossen sind.

(2) Wahlberechtigt sind bei Vorliegen der sonstigen Voraussetzungen auch diejenigen Deutschen im Sinne des Artikels 116 Abs. 1 des Grundgesetzes, die am Wahltage

1. als Beamte, Soldaten, Angestellte und Arbeiter im öffentlichen Dienst auf Anordnung ihres Dienstherrn außerhalb der Bundesrepublik Deutschland leben, sowie die Angehörigen ihres Hausstandes,
2. in den Gebieten der übrigen Mitgliedstaaten des Europarates leben, sofern sie nach dem 23. Mai 1949 und vor ihrem Fortzug mindestens drei Monate ununterbrochen in der Bundesrepublik Deutschland eine Wohnung innegehabt oder sich sonst gewöhnlich aufgehalten haben,
3. in anderen Gebieten außerhalb der Bundesrepublik Deutschland leben, sofern sie vor ihrem Fortzug mindestens drei Monate ununterbrochen in der Bundesrepublik Deutschland eine Wohnung innegehabt oder sich sonst gewöhnlich aufgehalten haben und seit dem Fortzug nicht mehr als 25 Jahre verstrichen sind. Entsprechendes gilt für Seeleute auf Schiffen, die nicht die Bundesflagge führen, sowie die Angehörigen ihres Hausstandes.

(3) Wohnung im Sinne des Gesetzes ist jeder umschlossene Raum, der zum Wohnen oder Schlafen benutzt wird. Wohnwagen und Wohnschiffe sind jedoch nur dann als Wohnungen anzusehen, wenn sie nicht oder nur gelegentlich fortbewegt werden.

(4) Sofern sie in der Bundesrepublik Deutschland keine Wohnung innehaben oder innegehabt haben, gilt als Wohnung im Sinne des Absatzes 1 Nr. 2 oder des Absatzes 2 Nr. 2 und 3

1. für Seeleute sowie für die Angehörigen ihres Hausstandes das von ihnen bezogene Schiff, wenn dieses nach dem Flaggenrechtsgesetz (in der Fassung der Bekanntmachung vom 4. Juli 1990, BGBl. I S. 1342) in der jeweils geltenden Fassung die Bundesflagge zu führen berechtigt ist,
2. für Binnenschiffer sowie für die Angehörigen ihres Hausstandes das von ihnen bezogene Schiff, wenn dieses in einem Schiffsregister in der Bundesrepublik Deutschland eingetragen ist,
3. für im Vollzug gerichtlich angeordneter Freiheitsentziehung befindliche Personen sowie für andere Untergebrachte die Anstalt oder die entsprechende Einrichtung.

(5) Bei der Berechnung der Dreimonatsfrist nach Absatz 1 Nr. 2 und Absatz 2 Nr. 2 und 3 ist der Tag der Wohnungs- oder Aufenthaltsnahme in die Frist einzubeziehen.

Article 12 Voting rights

(1) Have the voting rights all the Germans within the meaning of subparagraph 1 of Article 116 of the fundamental Law, which, the day of the election,

1. reached the 18 years age completed,
2. have had a residence for at least three months in the Federal Republic of Germany or which usually resides at it,
3. are not excluded from the voting rights under the terms of art 13.

(2) Also have the voting rights, on the condition of meeting the other conditions, the Germans within the meaning of subparagraph 1 of Article 116 of the fundamental Law which, the day of the election,

1. in their capacity as civils servant, soldiers, employees and workmen of the public services reside on ordinance of their employer apart from the Federal Republic of Germany, the members of their family also falling under the blow from these provisions,
2. reside in the areas of the other Member States of the Council of Europe, and this insofar as they lived in federal Republic of Germany at least three months in an uninterrupted way after 23 May 1949 and before their departure of the Federal Republic of Germany, or if they usually resided at it,
3. live in different areas located apart from the Federal Republic of Germany, and this insofar as they lived before their departure at least three months in an uninterrupted way in the Federal Republic of Germany or if they usually resided at it and that, since their departure, it did not run out a period of more than ten * years. The same applies to embarked on ships not beating German house and member sailors of their family.

(3) One understands by dwelling within the meaning of the present law any part encloses used to live there or to sleep there. However, the caravans and boats of dwelling are not regarded as dwelling that if they are not moved or if they are it only occasionally.

(4) If the categories of people hereafter do not have a dwelling in the Federal Republic of Germany, is regarded as dwelling within the meaning of No 2 of subparagraph 1 or No 2 of subparagraphs 2 and 3 of this article,

1. for the sailors and the members of their family, the boat whom they occupy if this last, under the terms of the law on the right of house published in the version of the publication of July 4, 1990, official Journal federal I, p. 1342) in the version respectively in force, is authorized to beat German house,
2. for the boatmen and the members of their family, the boat whom they occupy, provided that this one is registered in a shipping register held in the Federal Republic of Germany,
3. for the people achieving a sentence of emprisonment ordered by a court and for the other interned people, penal establishment or all other comparable establishment.

(5) Being a question of the calculation of the three months deadline according to No. 2 of subparagraph 1 and No. 2 and 3 of subparagraph 2, it is appropriate to include within this time the day of the beginning of residence or stay.

§ 12 Right to vote

(1) Voters are all Germans in the sense of the article 116 exp. 1 of the Basic Law, those on the election day

1. the eight tenth lebensjahr completed,
2. for at least three months in the Federal Republic of Germany a dwelling hold or otherwise normally are,
3. after § 13 are not excluded from the right to vote.

(2) Voters are also those Germans when being present the other prerequisites in the sense of the article 116 exp. 1 of the Basic Law, those on the election day

1. as officials, soldiers, employees and workers in the public service on arrangement of their service gentleman outside of the Federal Republic of Germany, as well as the members of their household live,
2. in the areas of the remaining member states of the Council of Europe live, if they at least three months continuously had after 23 May 1949 and before their Fortzug in the Federal Republic of Germany a dwelling or otherwise normally were,
3. in other areas outside of the Federal Republic of Germany live, if they at least three months continuously had before their Fortzug in the Federal Republic of Germany a dwelling or otherwise normally were and since the Fortzug no more than 25 years elapsed. Appropriate applies to sailors on ships, which do not lead the federal flag, as well as the members of its household.

(3) Dwelling in the sense of the law is each umschlossene space, which is used for living or sleeping. Campers and living ships are to be regarded however only then as dwellings, if it not or to be only occasionally moved.

(4) If they hold or had no dwelling in the Federal Republic of Germany, is considered as dwelling in the sense of the paragraph 1 No. 2 or the paragraph 2 No. 2 and 3,

1. for sailors as well as for the members of its household the ship referred by them, if this after the flag right law (in the version of the proclamation from 4 July 1990, BGBl. I P. 1342) in the valid in each case version the federal flag to lead is justified,
2. for Binnenschiffer as well as for the members of its household the ship referred by them, if this is entered in the Federal Republic of Germany in a naval register,
3. for in the execution of judicially arranged false imprisonment persons present as well as for other accommodation the institute or the appropriate mechanism.

(5) With the calculation of the period of three months in accordance with paragraph 1 NR. 2 and paragraph 2 NR. 2 and 3 is the day dwelling or into the period to include.
