Artikel 94 [Zusammensetzung des Bundesverfassungsgerichts]

(1) Das Bundesverfassungsgericht besteht aus Bundesrichtern und anderen Mitgliedern. Die Mitglieder des Bundesverfassungsgerichtes werden je zur Hälfte vom Bundestage und vom Bundesrate gewählt. Sie dürfen weder dem Bundestage, dem Bundesrate, der Bundesregierung noch entsprechenden Organen eins Landes angehören.

(2) Ein Bundesgesetz regelt seine Verfassung und das Verfahren und bestimmt, in welchen Fällen seine Entscheidungen Gesetzeskraft haben. Es kann für Verfassungsbeschwerden die vorherige Erschöpfung des Rechtsweges zur Voraussetzung machen und ein besonderes Annahmeverfahren vorsehen.

第94条 [連邦憲法裁判所の構成]

(1) 連邦憲法裁判所は、連邦裁判官およびその他の構成員をもって組織する。連邦憲法裁判所の構成員は、連邦議会および連邦参議院によって、それぞれ半数ずつ選挙される。これらの構成員は、連邦議会、連邦参議院、連邦政府またはこれらに相当するラントの機関に所属してはならない。

(2) 連邦法は、連邦憲法裁判所の構成および手続を規律し、ならびに、いかなる場合にその裁判が法律的効力を有するかを規定する。連邦法は、憲法訴願については、事前に出訴手段を尽くすことを条件とし、かつ、特別の受理手続を規定することができる。

Article 94 [The Federal Constitutional Court, composition]

(1) The Federal Constitutional Court shall be composed of federal judges and other members. Half of the members of the Federal Constitutional Court shall be elected by the Bundestag and half by the Bundesrat. They may not be members of the Bundestag, the Bundesrat, the Federal Government, nor of any of the corresponding institutions of a Land.

(2) The constitution and procedure of the Federal Constitutional Court shall be governed by a federal law which shall specify the cases in which its decisions have the force of law. Such law may make a complaint of unconstitutionality conditional upon the exhaustion of all other legal remedies and provide for a special admissibility procedure.
