Artikel 35 [Rechts- und Amtshilfe, Katastrophenhilfe](1) Alle Behörden des Bundes und der Länder leisten sich gegenseitig Rechts- und Amtshilfe. (2) Zur Aufrechterhaltung oder Wiederherstellung der öffentlichen Sicherheit oder Ordnung kann ein Land in Fällen von besonderer Bedeutung Kräfte und Einrichtungen des Bundesgrenzschutzes zur Unterstützung seiner Polizei anfordern, wenn die Polizei ohne diese Unterstützung eine Aufgabe nicht oder nur unter erheblichen Schwierigkeiten erfüllen könnte. Zur Hilfe bei einer Naturkatastrophe oder bei einem besonders schweren Unglücksfall kann ein Land Polizeikräfte anderer Länder, Kräfte und Einrichtungen anderer Verwaltungen sowie des Bundesgrenzschutzes und der Streitkräfte anfordern. (3) Gefährdet die Naturkatastrophe oder der Unglücksfall das Gebiet mehr als eines Landes, so kann die Bundesregierung, soweit es zur wirksamen Bekämpfung erforderlich ist, den Landesregierungen die Weisung erteilen, Polizeikräfte anderen Ländern zur Verfügung zu stellen, sowie Einheiten des Bundesgrenzschutzes und der Streitkräfte zur Unterstützung der Polizeikräfte einsetzen. Maßnahmen der Bundesregierung nach Satz 1 sind jederzeit auf Verlangen des Bundesrates, im übrigen unverzüglich nach Beseitigung der Gefahr aufzuheben. |
第35条 [司法共助および職務共助、災害救助](1) 連邦およびラントのすべての官庁は、相互に司法共助および職務共助を行う。 (2) ラントは、公共の安全または秩序の維持または回復のために、とくに重要な事件において、警察が連邦国境警備隊の支援がなければ任務を遂行できず、または著しく困難であるときは、警察の支援のために、連邦国境警備隊の力および施設を要請することができる。ラントは、自然災害またはとくに重大な災厄事故の場合に支援を受けるために、他ラントの警察力、他の行政官庁の力および施設、ならびに連邦国境警備隊および軍隊の力および施設を要請することができる。 (3) 自然災害または災厄事故が一つのラントの領域を超えて危険を及ぼすときは、連邦政府は、その有効な対処のために必要な限りで、ラント政府に対し、他ラントの警察力を使用する指示を与え、ならびに警察力を補強するために、連邦国境警備隊および軍隊の部隊を出動させることができる。1段による連邦政府の措置は、連邦参議院の要求があればいつでも、また、その他の場合も、危険の除去後速やかに解除しなければならない。 |
Article 35 [Judicial and administrative assistance](1) All federal and Land authorities shall render each other judicial and administrative assistance.(2) In order to maintain or restore public safety or order a Land may in particularly serious cases call upon forces and facilities of the Federal Border Guard to assist its police where without such assistance the police could not, or only with considerable difficulty, carry out an assignment. In order to cope with a natural disaster or a particularly serious accident a Land may request the assistance of the police forces of other Länder or the forces and facilities of other administrative authorities or of the Federal Border Guard or the Armed Forces. (3) Where the natural disaster or accident endangers a region larger than a Land the Federal Government may, in so far as necessary to effectively combat such danger, instruct the Land governments to place their police forces at the disposal of other Länder and employ units of the Federal Border Guard or the Armed Forces in support of the police forces. Measures taken by the Federal Government pursuant to the first sentence of this paragraph shall be revoked at any time if requested by the Bundesrat, otherwise as soon as the danger has been removed. |
