§ 43 Nachwahl

(1) Eine Nachwahl findet statt,

  1. wenn in einem Wahlkreis oder in einem Wahlbezirk die Wahl nicht durchgeführt worden ist,
  2. wenn ein Wahlkreisbewerber nach der Zulassung des Kreiswahlvorschlages, aber noch vor der Wahl stirbt.

(2) Die Nachwahl soll im Falle des Absatzes 1 Nr. 1 spätestens drei Wochen, im Falle des Absatzes 1 Nr. 2 spätestens sechs Wochen nach dem Tage der Hauptwahl stattfinden. Den Tag der Nachwahl bestimmt der Landeswahlleiter.

(3) Die Nachwahl findet nach denselben Vorschriften und auf denselben Grundlagen wie die Hauptwahl statt.

第43条 補欠選挙

(1) 補欠選挙は次に掲げる場合に行われる。

  1. １選挙区または１投票区において選挙が行われなかったとき、
  2. １選挙区候補者が選挙区候補者推薦の承認後、選挙前に死亡したとき。

(2) 補欠選挙は、主たる選挙の当日後、第１項１号の場合は遅くとも３週間以内、第１項２号の場合は遅くとも６週間以内に行われねばならない。補欠選挙の期日は、州選挙長が定める。

(3) 補欠選挙は主たる選挙と同一の規定により、および同一の基礎のうえで行われる。

Article 43 By-election

(1) A by-election takes place

  1. if, in an electoral district or an electoral district, the election were not carried out,
  2. if a candidate being reproduced on an electoral roll of district comes has to die during the time running out between the admission of the list of the candidates of district and the day of the election.

(2) The by-election must be organized at the latest in the three weeks which follow the day of the principal election in the case of No 1 of subparagraph 1 and at the latest in the six weeks which follow the day of the principal election in the case of No 2 of subparagraph 1. The president of the electoral commission of Land fixes the day of the by-election.

(3) The by-election is organized in accordance with the same regulations and on the same bases as the principal election.

§ 43 By-election

(1) A by-election takes place,

  1. if in a constituency or executed in an electoral district the election is not,
  2. if a constituency applicant after the permission of the set election suggestion, but still before the election dies.

(2) The by-election is in the case of the paragraph 1 NR. 1 at the latest three weeks, in the case of the paragraph 1 NR. 2 at the latest six weeks after the day of the main election take place. The national returning officer determines the day of the by-election.

(3) The by-election takes place according to the same regulations and on the same bases as the main election.
