Artikel 91a [Mitwirkung des Bundes auf Grund von Bundesgesetzen]

(1) Der Bund wirkt auf folgenden Gebieten bei der Erfüllung von Aufgaben der Länder mit, wenn diese Aufgaben für die Gesamtheit bedeutsam sind und die Mitwirkung des Bundes zur Verbesserung der Lebensverhältnisse erforderlich ist (Gemeinschaftsaufgaben):
  1. Verbesserung der regionalen Wirtschaftsstruktur,
  2. Verbesserung der Agrarstruktur und des Küstenschutzes.
(2) Durch Bundesgesetz mit Zustimmung des Bundesrates werden die Gemeinschaftsaufgaben näher bestimmt. Das Gesetz soll allgemeine Grundsätze für ihre Erfüllung enthalten.

(3) Das Gesetz trifft Bestimmungen über das Verfahren und über Einrichtungen für eine gemeinsame Rahmenplanung. Die Aufnahme eines Vorhabens in die Rahmenplanung bedarf der Zustimmnng des Landes, in dessen Gebiet es durchgeführt wird.

(4) Der Bund trägt in den Fällen des Absatzes 1 Nr. 1 und 2 die Hälfte der Ausgaben in jedem Land. In den Fällen des Absatzes 1 Nr. 3 trägt der Bund mindestens die Hälfte; die Beteiligung ist für alle Länder einheitlich festzusetzen. Das Nähere regelt das Gesetz. Die Bereitstellung der Mittel bleibt der Feststellung in den Haushaltsplänen des Bundes und der Länder vorbehalten.

(5) Bundesregierung und Bundesrat sind auf Verlangen über die Durchführung der Gemeinschaftsaufgaben zu unterrichten.

第91a条 [連邦法に基づく連邦の協力]

(1) 連邦は、以下の分野において、諸ラントの任務が全体にとって重要な意味をもち、かつ、連邦の協力が生活関係の改善のために必要なときは、諸ラントの任務の遂行に協力する（共同の任務）。
  1. 地域的経済構造の改善
  2. 農業構造および沿岸保護の改善
(2) 共同の任務の詳細は、連邦法が連邦参議院の同意を得て定める。その法律には、任務遂行のための一般原則が規定されなければならない。

(3) その法律は、共同の大綱計画の手続および組織について規律する。大綱計画にある企画を採用するためには、実施される地域のラントの同意が必要である。

(4) 連邦は、1項1号および2号の場合には、各ラントにおける支出の半額を負担する。1項3号の場合には、連邦は、少なくともその半額を負担するが、その際、分担の割合は、すべてのラントに対して均一に定めなければならない。詳細は、法律で定める。資金の提供は、連邦およびラントの予算における確定にまつものとする。

(5) 連邦政府および連邦参議院は、共同の任務の実施について、要求に基づいて、情報を得る権利を有する。

Article 91a [Participation of the Federation]

(1) The Federation shall participate in discharging the responsibilities of the Länder in the following areas provided that they are relevant to the community as a whole and that its participation is necessary in order to improve living conditions (joint responsibilities):
  1. improvement of regional economic structures;
  2. improvement of agricultural structure and coastal preservation.
(2) Joint responsibilities shall be specified by federal law requiring the consent of the Bundesrat. Such legislation should include general principles governing the discharge of responsibilities.

(3) The law shall provide for the procedure and institutions for joint overall planning. The inclusion of a project in overall planning shall require the consent of the Land in which it is to be carried out.

(4) In cases to which sub-paragraphs 1 and 2 of paragraph (1) of this Article apply the Federation shall meet one half of the expenditure in each Land. In cases to which sub-paragraph 3 of paragraph (1) of this Article applies the Federation shall meet at least one half of the expenditure; the proportion shall be the same for all Länder. Details shall be the subject of a law. Provision of funds shall be subject to appropriation in the budgets of the Federation and the Länder.

(5) The Federal Government and the Bundesrat shall, upon request, be informed about the discharge of joint responsibilities.
