Artikel 143b(1) Das Sondervermögen Deutsche Bundespost wird nach Maßgabe eines Bundesgesetzes in Unternehmen privater Rechtsform umgewandelt. Der Bund hat die ausschließliche Gesetzgebung über alle sich hieraus ergebenden Angelegenheiten.(2) Die vor der Umwandlung bestehenden ausschließlichen Rechte des Bundes können durch Bundesgesetz für eine Übergangszeit den aus der Deutschen Bundespost POSTDIENST und der Deutschen Bundespost TELEKOM hervorgegangenen Unternehmen verliehen werden. Die Kapitalmehrheit am Nachfolgeunternehmen der Deutschen Bundespost POSTDIENST darf der Bund frühestens fünf Jahre nach Inkrafttreten des Gesetzes aufgeben. Dazu bedarf es eines Bundesgesetzes mit Zustimmung des Bundesrates. (3) Die bei der Deutschen Bundespost tätigen Bundesbeamten werden unter Wahrung ihrer Rechtsstellung und der Verantwortung des Dienstherrn bei den privaten Unternehmen beschäftigt. Die Unternehmen üben Dienstherrenbefugnisse aus. Das Nähere bestimmt ein Bundesgesetz. |
第143b条 [ドイツ連邦郵便の民営化](1) 特別財産のドイツ連邦郵便は、連邦法の基準に従い、私法形式の企業に移行する。連邦は、これに伴うすべての事務に関して、専属的立法権を有する。(2) 移行前に存する連邦の専属的権利は、連邦法により、過渡期の間、ドイツ連邦郵便「郵便事業」およびドイツ連邦郵便「テレコム」をもとに作られる企業に付与することができる。連邦は、少なくとも法律施行後5年間は、ドイツ連邦郵便「郵便事業」の後継企業の資本の過半を手放すことはできない。これについては、連邦参議院の同意を伴う連邦法を必要とする。 (3) ドイツ連邦郵便に勤務する連邦官吏は、法的地位を維持しながら、上司の責任のもとに、私企業に従事する。当該私企業は、職務上の命令権を行使する。詳細は、連邦法で定める。 |
Article 143b [Transformation of the Deutsche Bundespost](1) The Deutsche Bundespost Special Fund shall be transformed into private companies in accordance with the provisions of a federal law. The Federation shall have exclusive legislative jurisdiction in respect of all matters ensuing from this transformation.(2) The exclusive rights of the Federation existing before the transformation may be granted by federal law to the companies ensuing from the Deutsche Bundespost POSTDIENST (postal services) and the Deutsche Bundespost TELEKOM (telecommunications) for a transitional period. The Federation shall retain the majority holding in the successor company to the Deutsche Bundespost POSTDIENST for at least five years after the law comes into force. A federal law with the consent of the Bundesrat shall be required. (3) Federal civil servants of the Deutsche Bundespost shall be employed by the private companies; their legal status and the responsibilities of the employer shall not be affected. The companies shall exercise the powers of a public employer. Details shall be the subject of a federal law." |
